📜 Motorcycle Rental Terms & Conditions
Rider-Friendly Summary

Adventure travel involves real-world variables. Our goal is always to be fair, clear, and communicative — while setting realistic expectations from the start. No fine print, no hidden gotchas — just straightforward rules so you know exactly what’s included, what’s expected, and how we’ve got your back on the road.

🪪 Rider Requirements

  • Valid motorcycle license from the rider’s home country

  • International Driving Permit (IDP) strongly recommended

  • Minimum rider age: 21 years

  • At least one (1) year of recent motorcycle riding experience on similar motorcycles

  • Passport or government-issued photo ID required

  • Rider must be physically and mentally fit to operate a motorcycle and must not be under the influence of alcohol, drugs, or medications that impair riding ability

  • Rider agrees to comply with all Colombian traffic laws and regulations and is solely responsible for any fines, tickets, violations, or impoundments

  • Approved safety gear, including a helmet, is required at all times while riding

  • Colombia Moto Adventures reserves the right to refuse or terminate the rental if the rider does not meet these requirements or is deemed unsafe to ride, without refund

 

📝 Booking & Payments

  • A 50% deposit reserves your bike. Pay the balance before your ride starts

  • We accept credit card payments via PayPal

  • We do not accept cash

💰 Cancellations & Refunds

  • Cancel 31+ days before the rental start date: 50% refund minus PayPal processing fees

  • Cancel with 30 days’ or less notice before the rental start date: no refund (including illness, flight delays, or changes in personal travel plans)

  • Once your rental starts: no refunds for unused days, early return, or trip interruption

⚖️ No Consequential Damages

  • Colombia Moto Adventures is not responsible for any indirect, incidental, special, or consequential damages arising from or related to the rental or use of the motorcycle. This includes, but is not limited to, lost or delayed flights, missed hotel reservations, additional transportation costs, unexpected lodging expenses, loss of income, trip interruption, or any other costs not directly related to the motorcycle rental itself.

  • Colombia Moto Adventures’ total liability is strictly limited to the total amount paid for the motorcycle rental. No additional claims may be made. 

  • Loss of enjoyment or vacation value is not compensable.

Example Scenario
A rider rents a motorcycle from Colombia Moto Adventures for a 10-day trip. On Day 4, the motorcycle develops a mechanical issue and cannot be ridden that day. As a result:

  • The rider misses a prepaid hotel reservation

  • They book a last-minute hotel and taxi

  • They miss a scheduled flight later in the trip

  • They lose a day of work back home due to the delay

 

How the Clause Applies
Under the No Consequential Damages clause, Colombia Moto Adventures is not responsible for:

  • Missed hotel costs

  • Taxi or alternate transportation

  • Flight change fees

  • Lost wages or business income

  • Any additional lodging or travel expenses

The maximum possible liability, even if Colombia Moto Adventures were found responsible, is limited to the amount the rider paid for the motorcycle rental.


Example: If the rider paid $750 USD, that is the absolute maximum recoverable amount—even if total out-of-pocket losses were higher. No additional claims can be made beyond that amount.

⚠️ Inherent Risks & Assumption of Risk

  • Adventure motorcycle travel involves real-world conditions and inherent risks that cannot be eliminated. These may include mixed terrain (rough pavement, gravel, dirt), changing weather, remote locations, limited communications, fatigue, altitude, wildlife, river crossings, mechanical issues, and other natural or environmental hazards.

  • Conditions may change without notice, and delays, route changes, or difficulty accessing assistance can occur. Riders may also become temporarily separated from the group or lose communication coverage in remote areas.

  • By participating, each rider voluntarily accepts full responsibility for all known and unknown risks associated with adventure motorcycle travel and chooses to participate with full awareness of these risks.

🛡️ Insurance & Coverage

  • SOAT is included as required by Colombian law. It provides basic & limited emergency medical coverage related to traffic accidents, subject to SOAT rules and limits.

  • Medical insurance does not cover motorcycle damage or third-party liability

  • Optional motorcycle damage insurance is available for riders who want additional protection

 

The optional damage insurance applies only to physical damage to the rented motorcycle itself. It does not cover towing or recovery costs, fines, tickets, settlements, impound or storage fees, legal costs, third-party claims, or any other expenses.

Unless optional damage insurance is purchased and applicable, the renter is financially responsible for any damage, loss, or theft of the motorcycle or accessories during the rental period.

 

The renter is fully responsible for:

  • All third-party claims or damages

  • Traffic fines, tickets, or penalties

  • Towing, recovery, and roadside assistance costs

  • Impound, storage, or release fees

  • Settlements, legal costs, or related expenses incurred during the rental period

🔍 Motorcycle Condition & Inspection

  • Each motorcycle is provided in safe, working condition and documented with photos and a condition report at pickup

  • It is the renter’s responsibility to thoroughly inspect the motorcycle at pickup, including (but not limited to) tire condition and tread depth, suspension and shocks, chain tension and sprocket wear, brakes, controls, and overall condition

  • The renter agrees to review, note, and confirm any existing wear or damage before departure

  • Any damage or excessive wear not documented at pickup is the renter’s responsibility

  • No exceptions will be made once the motorcycle has departed the pickup location

  • Mechanical failures can occur even on properly maintained motorcycles, especially under off-road, high-altitude, or remote riding conditions. Mechanical wear, failure, or breakage does not imply negligence.

🛞 Motorcycle Design & Rider Acknowledgment

  • The renter acknowledges that all motorcycles provided by Colombia Moto Adventures are mechanically operated motorcycles and do not include electronic rider aids, including (but not limited to) ABS, traction control, stability control, or other electronic safety systems.

  • The renter confirms they are experienced and comfortable operating a motorcycle without electronic rider assistance and accepts full responsibility for riding within their skill level and conditions.

 

✅ Additional Terms for All Rentals

🛠️ Repairs, Recovery & Trip Interruption

  • In the event of a mechanical issue, breakdown, or damage to the motorcycle during the rental period, Colombia Moto Adventures will make reasonable efforts to assist with repair and/or recovery of the motorcycle.

  • Colombia Moto Adventures may, at its discretion, cover reasonable repair and recovery costs for the motorcycle itself. However, the company is not responsible for any related or resulting expenses, including (but not limited to) hotel stays, meals, transportation, trip delays, downtime, loss of use of the motorcycle, or lost rental time. These are considered consequential damages and are not reimbursable.

  • Reasonable efforts do not guarantee immediate assistance, specific outcomes, or on-site repairs, and may be limited by location, weather, road access, and safety conditions.

⛔ No Guarantee of Immediate Repair or Replacement

  • Due to Colombia’s geography, remote locations, road conditions, and limited access to parts or services in certain regions, Colombia Moto Adventures does not guarantee immediate repair, recovery, replacement motorcycles, or continuation of the trip in the event of a mechanical issue, breakdown, or damage.

  • Any assistance provided is subject to availability, location, safety considerations, and logistical limitations. Reasonable efforts will be made when possible, but outcomes cannot be guaranteed.

🌧️ Events Beyond Our Control (Force Majeure)

  • Force Majeure refers to events beyond the reasonable control of Colombia Moto Adventures that prevent or delay the performance of services. These events include, but are not limited to, severe weather, flooding, landslides, road closures, accidents, mechanical failures beyond reasonable control, protests or civil unrest, strikes, government actions or restrictions, natural disasters, or any other unforeseen circumstances that make travel unsafe, impractical, or impossible.

  • Delays, route changes, shortened trips, or interruptions caused by Force Majeure do not qualify for refunds, compensation, or reimbursement, and riders are responsible for any additional expenses incurred as a result.

Example Scenario
Overnight rain causes a landslide that blocks the only road into the next town. Local authorities close the road for safety reasons. As a result:

  • The route must be changed

  • The rider arrives late

  • A prepaid hotel reservation is missed

  • An extra night of lodging is required

  • The schedule is shortened

How the Force Majeure Clause Applies

  • Colombia Moto Adventures is not responsible for:

  • Delays or route changes caused by the landslide

  • Missed hotels or altered accommodations

  • Paying for additional or replacement hotels

  • Extra lodging or transportation costs

  • Shortened riding days or skipped destinations

Because the interruption was caused by weather and road conditions beyond reasonable control, the situation does not qualify for a refund or compensation. The rider is responsible for additional expenses incurred as a result. The trip continues using the safest available alternative route once conditions allow.

🏨 Third-Party Services & Accommodations

  • We may book, arrange, or recommend third-party services such as hotels, transportation, guides, mechanics, or other providers. These services are operated independently, and Colombia Moto Adventures is not responsible for their availability, changes, cancellations, performance, or service quality.

⛽ Fuel & Maintenance

  • The motorcycle must be returned with a full tank of fuel and in the same condition in which it was received, normal wear from proper use excepted

  • For multi-day trips, Colombia Moto Adventures strongly recommends that riders visit a local mechanic every 3–5 riding days for routine checks, including (but not limited to):

  • Chain cleaning, lubrication, and proper tension adjustment

  • Tire pressure checks and adjustment

  • Inspection of bolts, fasteners, and controls

  • General safety and wear checks appropriate for extended riding

  • Routine maintenance during the rental period is the rider’s responsibility and helps prevent avoidable mechanical issues in remote areas

  • Failure to perform basic maintenance may result in preventable damage, for which the rider may be held responsible

 

🧰 Luggage & Accessories

  • Motorcycles may be equipped with non-locking top boxes

  • The renter agrees to use the included strap to secure the top box closed at all times, especially when riding off-road or on rough terrain

  • Damage, loss of contents, or opening of the top box due to failure to properly secure it is the renter’s responsibility

  • Colombia Moto Adventures does not guarantee the security of luggage or contents while parked or unattended.

 

📱 Personal Property & Weather Exposure

  • Colombia Moto Adventures is not responsible for loss of or damage to the renter’s personal property, including (but not limited to) phones, cameras, electronics, documents, clothing, or other items carried on the motorcycle or stored in luggage.

  • Riding conditions may include rain, river crossings, mud, dust, vibration, and rough terrain. Luggage boxes are not guaranteed to be waterproof, dustproof, or secure against water intrusion. The renter is responsible for protecting personal items from weather, vibration, and environmental exposure.

 

🚫 Alcohol & Drugs

  • Riding under the influence of alcohol, drugs, or impairing medication voids all insurance and makes the renter fully responsible for all damages and costs.

🛣️ Route, Schedule & Accommodation Flexibility

  • Routes, daily distances, riding times, accommodations, and surfaces are planned in advance but may change due to weather, road conditions, safety considerations, local availability, or other factors beyond our control. Colombia Moto Adventures makes on-the-ground decisions to prioritize rider safety, group flow, and overall trip quality.

  • Descriptions of services, equipment, routes, accommodations, surfaces, and highlights on the website or in booking communications are for informational purposes only and are representative. Changes to routes, surfaces, accommodations, or highlights are a normal part of adventure travel and do not constitute a failure to deliver the tour or rental as described.

🧭 Self-Guided Riding Responsibility

  • Self-guided tours are designed for riders who are comfortable navigating independently and making their own day-to-day riding decisions. Riders are responsible for following provided route information, managing time and pace, and reaching each day’s destination on their own. Colombia Moto Adventures does not guide, lead, or escort self-guided riders on the route, and daily progress is the rider’s responsibility.

🛠️ Basic Mechanical Awareness

  • Self-guided riders are expected to have basic motorcycle travel skills, including the ability to read maps, assess road conditions, and handle minor roadside issues such as flat tires, changing tire tubes or simple adjustments. We provide reliable motorcycles, basic tools, and emergency contact support, but self-guided travel requires a reasonable level of independence and problem-solving on the road.

🧑‍✈️ Rider Responsibility & Skill Level

  • Each rider is responsible for operating the motorcycle within their own skill level at all times. Guided tours are not instructional or training programs. Riders must be comfortable managing their motorcycle on pavement, gravel, and variable road conditions without exceeding their personal abilities.

  • If a rider’s pace, control, or decision-making creates a safety risk for themselves, the group, or the guide, Colombia Moto Adventures reserves the right to adjust the route, separate riders, or end that rider’s participation in the tour without refund.

  • Guides do not supervise individual riding decisions and are not responsible for rider errors, loss of control, or crashes.

🗺️ Your Responsibility

  • Ride safely, follow local traffic laws, and respect Colombia’s communities and environment. Off-road riding is encouraged, but reckless use or intentional damage is your responsibility.

⚖️ Governing Law

  • This agreement is governed by the laws of the Republic of Colombia. Any disputes shall be resolved exclusively in Colombian courts.

📄 Entire Agreement

  • This agreement constitutes the entire agreement between the parties and supersedes any prior discussions, communications, or representations, whether written or oral.

✍️ Agreement Acceptance

  • By booking and/or taking possession of the motorcycle, the renter confirms they have read, understood, and agreed to all terms and conditions of this agreement.
